Firm Seeks MDL for Business Interruption Claims

Burns Bowen Bair LLP has joined with other firms seeking to consolidate hundreds of federal lawsuits alleging that insurers have wrongly denied coverage to businesses impacted by COVID-19 shutdowns.

In briefs before the Judicial Panel on Multidistrict Litigation, attorneys representing the plaintiffs point out that the insurers have argued against an MDL claiming that variations in individual polices make an MDL impractical. However, the filings note that many of the provisions of the policies “are nearly identical across insurers,” and that an MDL would be the most effective means of resolving the claims.
