A group of policyholders have asked an Illinois federal judge Wednesday not to let Society Insurance Co. use a limited bellwether ruling to pursue dismissal of all civil authority and contamination claims in multidistrict litigation over its refusal to cover losses stemming from the COVID-19 pandemic.
The group has asked U.S. District Judge Edmond Chang to reject Society’s request to apply his ruling which tosses civil authority claims from three bellwethers in the MDL, saying the request is part of the insurance company’s plan to refuse to cover all COVID-19-related business losses and then take “every step possible to hinder [their] litigation of those denied claims.”
